1. Definitions Positive Paths Personal Life Coaching is the provider of Personal Life Coaching. 'Client' means the person entering into agreement with Positive Paths for the purpose of Personal Life Coaching. 2. Booking Conditions You must complete our booking form, email or call us to arrange your booking and any payments. 3. Post We aim to confirm your session for coaching within 24 hours of receiving your completed form and deposit. If you do not hear from us within 24 hours please call us on 0870 626 4731. 4. Fees The fees for the personal life coaching include the 1 to 1 ½ hours one to one coaching. 5. Payment Full payment must be made in advance of the coaching session. Cheques should be made payable to ‘Positive Paths’. Please write your coaching date on the reverse of the cheque along with all correspondence you include. 6. Cancellations & Transfers Transfer of a booking to an alternative date is subject to the following: You must give 24 hours notice to cancel a booking or full payment will be due for your session. 7. Cancellation by Positive Paths Personal Life Coaching Positive Paths Personal Life Coaching reserves the right to alter the coaching content or coaching times at any time without incurring any liability. Positive Paths Personal Life Coaching reserve the right to cancel or postpone the course/coaching without liability and participants will be offered an alternative event date, a credit note or a refund. 8. Client Obligations In consideration of the coaching to be rendered by Paths Personal Life Coaching under this agreement the participant agrees : 1. To pay the fee in full, without deductions. 2. To indemnify and keep indemnified Paths Personal Life Coaching from and against any and all liability and loss damage (whether civil or criminal) suffered. This also includes legal fees or costs incurred by Paths Personal Life Coaching resulting from a breach of this agreement by the participant, his or her employees or agents 3. Not to solicit any of the other participants of Paths Personal Life Coaching. 4. That subject to non fulfilment of the terms stated in clause 5 .0, the coaching fee is non refundable under any circumstances and is solely at the discretion of Paths Personal Life Coaching. 5. Not to cause or permit anything to damage or endanger the intellectual property, or to assist or allow others to do so, of Positive Paths Personal Life Coaching property. This includes, but is not restricted to: copyright, stationery, logo, participant lists, unrecognised design rights, website, course materials and any other item produced by Positive Paths Personal Life Coaching. 6. That Positive Paths Personal Life Coaching is not a provider of employment, nor is it an agency for the provision of clients. 7. That in the eventuality Positive Paths Personal Life Coaching is liable to any extent under these terms and conditions or general/common law, the liability of Positive Paths Personal Life Coaching is limited to the amount of fee paid by the participant. 8. That any publicity, information, event/coaching agenda, specifications supplied by Positive Paths Personal Life Coaching in relation to the supply of events/coaching are for guidance only and are subject to reasonable alterations by Positive Paths Personal Life Coaching and at Positive Paths Personal Life Coaching’s discretion without the prior need to obtain consent from the participant. 9. That Positive Paths Personal Life Coaching is not liable in any manner if the events/coaching contains materials, methods, techniques or any other form of information which the participant is already familiar with. 9. Materials/documentation Any material or documents (excluding Curriculum Vitae) submitted to Positive Paths Personal Life Coaching becomes the property of Positive Paths Personal Life Coaching and can be used in any way it sees fit. Photographs of the participants will be taken during live events and may be used for marketing. If you do not agree to your image being used in this manner please inform a member of Positive Paths Personal Life Coaching staff prior to the photographs being taken. 10. Disclaimer The client is entirely responsible for hiring the services of any of the coaches displayed on this website and understands that none of the coaches are employees of Positive Paths Personal Life Coaching. The participant hires the services of the coach independently of Positive Paths Personal Life Coaching and is responsible for due diligence when hiring the coach. This disclaimer includes both coaches selected by the participant and coaches selected by Positive Paths Personal Life Coaching. The participant fully absolves Positive Paths Personal Life Coaching for any liability whatsoever. The participant agrees to indemnify and keep indemnified Positive Paths Personal Life Coaching from and against any and all liability and loss damage (whether civil or criminal) suffered. This also includes legal fees or costs incurred by Positive Paths Personal Life Coaching resulting from a breach of this agreement by the participant, his or her employees or agents. Positive Paths Personal Life Coaching has not made any representation to guarantee success as a Life Coach of any participant in any of the coaching/mentoring supplied by Positive Paths Personal Life Coaching. 11. Changes to Terms & Conditions Positive Paths Personal Life Coaching reserves the right to update these terms and conditions as it sees fit and the client agrees to indemnify and keep indemnified Positive Paths Personal Life Coaching from and against any and all liability and loss damage (whether civil or criminal) suffered. This also includes legal fees or costs incurred by Positive Paths Personal Life Coaching resulting from a breach of this agreement by the participant his or her employees or agents as a result of changes made. It is the responsibility of the participant to keep up to date with the current terms and conditions which will at all times be displayed on the website. 12. Miscellaneous This Agreement will be interpreted, construed and enforced in all respects in accordance with the laws of England and the English Courts shall have non-exclusive jurisdiction in connection with any disputes that arise between you and us. You may not assign or novate or otherwise dispose of this Agreement, by operation of law or otherwise. We shall be entitled to assign or novate this Agreement without your consent. We shall be entitled to sub-contract our obligations and responsibilities under this Agreement to any third party without your consent. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. Notwithstanding any other provision in this Agreement, nothing in this Agreement is intended to confer on any third party any right to enforce any terms of this Agreement (save for any assignee of ours).
